Opinion: Trump administration clearly doesn't understand the point of Title IX

 Title IX, enacted as part of the Education Amendments of 1972, was designed to ensure that no person is excluded from participation in, denied the benefits of, or subjected to discrimination under any education program or activity receiving federal financial assistance, on the basis of sex. In other words, it’s a civil rights law meant to protect students — particularly women — from gender-based discrimination in education, including in areas like athletics, academics, and perhaps most significantly, sexual harassment and assault.

Unfortunately, the Trump administration’s changes to Title IX enforcement, particularly those implemented by former Education Secretary Betsy DeVos, revealed a fundamental misunderstanding — or outright disregard — for what Title IX is meant to accomplish. Rather than upholding protections for survivors of sexual violence and discrimination, the administration shifted the balance toward shielding institutions and accused individuals, at the cost of victims’ voices and safety.

One of the most controversial revisions came in the form of stricter rules for handling sexual misconduct cases. The new regulations narrowed the definition of sexual harassment, required live hearings with cross-examinations (even in K-12 settings), and limited schools’ responsibilities to only addressing incidents that occurred on campus or within official programs. These changes weren’t just tone-deaf — they were dangerous. They created barriers for survivors to come forward, often re-traumatizing them in the process.

By emphasizing due process rights for the accused — an important principle, no doubt — the administration failed to strike a balance that also preserved protections for victims. The argument that the Obama-era guidelines were too lenient or led to overreach is valid in certain cases, but the Trump administration’s wholesale rollback of protections went far beyond course correction. It fundamentally undermined the spirit of Title IX: to foster safe and equitable educational environments for all students.

Moreover, the political framing of Title IX reforms under Trump was heavily influenced by reactionary culture wars rather than sound policy. The administration often painted Title IX enforcement as part of a “radical feminist agenda” or as a tool of political correctness run amok. This rhetoric ignored the lived realities of countless students — predominantly women — who experience sexual violence during their academic careers and turn to their schools for justice and safety.

Title IX isn’t perfect, and there’s always room for improvement in how schools address allegations of sexual misconduct. But the Trump-era revisions prioritized institutional protection and public relations over student welfare. In doing so, they revealed a lack of empathy, a deficit of understanding, and an unwillingness to engage meaningfully with the law’s original purpose.

As the Biden administration has since moved to reverse many of these harmful policies, it's crucial to remember what Title IX stands for. It’s not about politics or partisanship. It’s about ensuring that every student — regardless of gender — has a fair shot at education free from discrimination, harassment, or fear.

The Trump administration may have misunderstood Title IX, but the rest of us must not.
